What is the E-2 investor visa?

The E-2 is a nonimmigrant visa for citizens of countries that hold a commerce treaty with the United States. It is based on a substantial investment in a real, operating U.S. business. Buying a franchise is one common way investors structure it. Eligibility depends on your nationality, the investment, and your role in the business, and is always assessed by a licensed immigration attorney.

My country is not on the E-2 treaty list. Do I have options?

Possibly. Investors from non-treaty countries (Brazil, for example) often study the EB-5 immigrant investor program, which requires a larger investment and has its own rules, or other routes such as the L-1 for transferring executives of an existing company. Each path has different requirements. An immigration attorney maps which ones fit your case.

Does buying a franchise guarantee a visa?

No. Buying a business, franchise or not, never assures any immigration outcome. What a franchise offers is a proven operating model that can support a well-documented business plan, one of several elements attorneys use to build a strong case. The decision always belongs to the U.S. government, and the strategy always belongs with your licensed attorney.

Can my family come with me?

Investor visa categories generally include provisions for spouses and dependent children. Rules on work and study authorization vary by visa type and change over time. This is exactly the kind of family planning your consultation and the partner attorneys address case by case.
